This is a frequently asked question, and the surprising answer is, they don’t. So long as your child is a minor, they do not get to pick the parent they want to live with, and here is why: Kids don’t always make the best decisions. It is very possible (maybe likely) that a child might pick the house with no rules where they get cake for breakfast and no one cares if they do their homework.
That is not to say that no one cares what the child thinks. If a child has a legitimate reason for wanting to spend more time with one parent, the court can take that into consideration.
